Terms and Conditions
- Introduction
Please review these terms of sale carefully before making a purchase. You will be required to accept these terms prior to placing any order through our website.
In these terms of sale, “we,” “us,” and “our” refer to millionpatterns.com, while “you” and “your” refer to the customer or potential customer who intends to purchase products from us.
- Order process
Our product listings on this website serve as an “invitation to treat.” By placing an order, you make a contractual offer to purchase the selected items. A binding contract between you and us is only established once we formally accept your order, as detailed below.
To complete a purchase, please follow these steps:
1) Select the products you wish to purchase and add them to your shopping cart. Proceed to the checkout.
2) If you are a new customer, create an account and log in; if you already have an account, simply enter your login details.
3) After logging in, confirm your order along with your acceptance of these terms of sale.
4) Depending on your selected payment method, Stripe will process your payment.
5) You will receive an initial acknowledgment from us.
6) After verifying the availability of your requested products, we will either send an order confirmation (at which point your order becomes a binding contract) or notify you by email if we cannot fulfill your order.
We recommend that you download and retain a copy of these terms of sale for your records, as we may update them periodically. The terms specific to your purchase may not remain accessible on the website.
Before submitting your order, you will have the opportunity to review and correct any input errors. Please ensure your order details are accurate before finalizing your purchase.
These terms of sale are provided solely in English.
- Price and payment
We provide digital content in a downloadable format, with product prices displayed on our website. Given the extensive range of products, some prices may occasionally be incorrect. Prices will be verified during the purchase process, ensuring you are charged the correct amount.
Payment is required at the time you place your order. If we do not receive full payment in cleared funds, we reserve the right to withhold the products and/or cancel the contract.
Prices listed on the website exclude taxes. Applicable taxes will be calculated and displayed at checkout.
All payments must be made by credit card or by any other method specified on our website.
Prices are subject to change at any time, but such changes will not affect orders that have already been confirmed.
If you have any disputes regarding a payment, please contact us immediately and provide full details of your claim. Submitting an unjustified charge-back (credit card, debit card, or other payment reversal) will require you to repay, within 7 days of the charge-back: (i) the full amount of the charge-back; (ii) any third-party fees we incur in relation to the charge-back (including bank or payment processor fees); and (iii) all reasonable costs, losses, and expenses incurred in recovering these amounts (including legal fees and debt collection costs).
If you submit an unjustified charge-back, we reserve the right to terminate any contract between us by issuing written notice.
For clarity, if you fail to recognize or recall a charge on your card or financial statement and initiate a charge-back as a result, this will be considered an unjustified charge-back.
- Warranties and Ownership of Digital Products
By placing an order with us, you warrant that:
You are legally capable of entering into binding contracts and have the authority, power, and capacity to agree to these terms of sale.
1) The information provided in your order is accurate and complete.
2) You can accept delivery of the products.
3) All purchases consist of downloadable digital files, delivered via an emailed link to the registered account holder, and accessible anytime on the Transactions page within your Account.
Upon delivery, all products are at your risk. Ownership of the products transfers to you only after:
The products have been delivered, and
We receive full payment of all amounts due for the products, including any applicable delivery charges.
Until ownership transfers to you, you hold the products as our fiduciary agent. If you are a business customer, you must store the products separately from other goods and ensure they are clearly identifiable as our property.
We reserve the right to seek payment for the products even if ownership has not yet transferred to you.
- Refund Policy
Due to the nature of our products as digital downloadable items, refunds are generally not provided. However, in the event of force majeure, such as natural disasters, acts of war, government restrictions, or significant internet disruptions, or if a technical issue in our delivery process prevents access to the purchased product for more than seven calendar days, we commit to issuing a full refund.
Refunds will typically be processed via the same payment method originally used for the purchase. We aim to process any validly requested refunds within 30 days from the receipt of your cancellation notice.
- Intellectual Property
These terms of sale do not constitute or include any transfer or license of intellectual property rights. They do not grant rights to any works (including software, literary works, or other content) contained in or associated with the products, nor do they govern any third-party services related to the products.
- Limitations and exclusions of liability
Nothing in these Terms of Sale will: (a) limit or exclude liability for death or personal injury caused by negligence; (b) limit or exclude liability for fraud or fraudulent misrepresentation; (c) limit liability in any way that is not permitted under applicable law; or (d) exclude any liability that cannot be excluded under applicable law. If you are a consumer, any statutory rights you hold that cannot be excluded or limited are unaffected by these Terms of Sale.
The liability limitations and exclusions outlined in this section (and elsewhere in these Terms of Sale): (a) are subject to the paragraph above; and (b) apply to all liabilities arising under or related to these Terms of Sale, including those arising in contract, tort (including negligence), or breach of statutory duty.
We are not liable for any business losses, including but not limited to loss of profits, income, revenue, use, production, anticipated savings, business opportunities, contracts, or goodwill. Additionally, we are not liable for any loss or corruption of data, databases, or software, nor for any special, indirect, or consequential losses or damages.
